General Terms and Conditions

The subject of this agreement is the use of the «Echter Schweizer Onlineshop» quality seal (hereinafter «Badge») by the shop operator (hereinafter «Member») following successful certification and payment of the membership fee.

The Member confirms that the following criteria are continuously met:

The Member grants the operator the right to verify compliance with the certification criteria:

• Document review: Submission of Commercial Register extract, AHV (Swiss social security) confirmations, lease agreement/proof of ownership for business premises.
• On-site inspection: In the event of justified suspicion, an on-site visit may be conducted with 48 hours' notice.
• Random checks: The operator may select up to 10% of members annually for a random audit.

The following rules apply to the use of the Badge:

• The Badge may only be displayed on the certified domains.
• The Badge may not be altered, distorted, or otherwise modified.
• The Badge must be integrated according to our technical instructions.
• After termination of membership, the Badge must be removed within 24 hours.

Membership is subject to a fee. Current fees are communicated before the conclusion of the contract.

• The fee is due upon invoicing (payment term: 10 days).
• In case of non-payment, the Badge will be deactivated after a reminder.
• Fees already paid will not be refunded in case of early termination or revocation.

The following actions are prohibited and will result in immediate revocation of the Badge:

• False information during certification
• Use of the Badge on non-certified websites
• Sharing the Badge code with third parties
• Manipulation of the Badge widget
• Any actions that damage the reputation of the quality seal

• Membership begins with the activation of the Badge after receipt of payment.
• The term is 12 months (or as agreed in the offer).
• Termination is possible with 30 days' notice before the end of the term.
• Without termination, the membership automatically renews for another 12 months.
• Extraordinary termination by the operator is possible at any time in case of serious violations.

The operator is not liable for lost profits, revenue losses, or other indirect damages in connection with the use or non-use of the Badge. Liability is limited to the amount of the annual fee paid.

The Member indemnifies the operator against all third-party claims arising from misuse of the Badge.

B.9 Amendments to the GTC

The operator may amend these GTC with reasonable notice (at least 30 days). The Member will be notified by email. In the event of material changes, a special right of termination applies.
